Message to us from Michelle McIlveen MLA for Strangford 18.03.10

I would like to thank you for the fantastic job that you, other parents and interested parties have done to raise the public profile of this very important issue. This is a matter that has been and will continue to be of great concern to me and my Party colleagues. It was extremely heartening that so many parents were able to take time out of their busy schedules to attend at the debate on Monday. I know that many would have liked to have been able to come. I was very pleased that we were able to obtain cross-Party support for our calls on the Minister to reconsider her decision. This is due in no small part to the lobbying power of parents and I would encourage you to keep up this fantastic effort.


Mervyn Storey, Chairman of the Education Committee, and I met with the Finance Minister Sammy Wilson following the debate on Prep Department funding to discuss the way forward in relation to current crisis created by the Education Minister. A number of options were discussed depending on the actions of the Minister - however, what we can confirm is that Sammy is awaiting legal opinion from the Departmental Solicitors Office clarifying whether or not the Minister has breached the Ministerial Code by refusing to bring this issue to the Executive. We would contend that she is required to bring the matter to her Executive colleagues as the issue is novel and contentious and failure to this puts her breach of the Code. This legal opinion is due early next week. If the Minister chooses to ignore the legal advice it is our view that this would provide the basis for an application for judicial review of her decision.

The Minister and her Party colleagues stated in the debate that the decision will be based on the outcome of the equality impact assessment of the proposal to withdraw funding from the Prep Departments to see whether it will have an adverse effect on any category specified in equality legislation. The Education Committee has been informed that the Education Department will not be in a position to discuss the outcome of the EQIA until early April.

In the meantime, however, it is our understanding that the budget allocations will be made to the Education and Library Boards and the Voluntary Grammars on the 25th March 2010. We suspect that for those schools with Prep Departments their budgets will be reduced accordingly. This is something which concerns us and we will be watching closely.

As ever, my Party colleagues and I will endeavour to keep you updated with developments on this issue. You can be assured of our continued support on this issue and that we will do all we can to bring this issue to a satisfactory conclusion.

ACTION REQUIRED- Get your pens out again!

As we continue to push forward, we urge all parents to write letters to (or to email) the Office of First and Deputy First Minister requesting that the entire matter of the proposed withdrawal of preparatory school funding be placed on the Agenda before the Executive.


The reason for this is that Sinn Fein still exercises a veto and unless the matter is put on the Agenda by the joint Office then decision making power remains with the Minister for Education.

To be clear, the Motion passed on 15th March, does not defeat the proposal.

Further to the relevant motion passed on 15th March 2010, I am writing to request that the entire matter of the proposed withdrawal of preparatory school funding be placed on the Agenda before the Executive.


I do not feel that the Education minister has treated my child(ren) fairly, in that she has failed to respect their individual rights and consult with them on their views/ opinions of their school. The Education Minister has failed to try to identify "a change management process" in a constructive manner to minimise any detrimental impact to my child(ren). Instead she proposes the withdrawal of funds that could potentially have the impact that the "controlled" preps may need to close. This would obviously cause my child(ren)'s safe and happy schooling environment to be disrupted.

Parent's Group Response re motion of 15/03/10

Dear Parent/Guardian,

Following on from our meeting last Monday at Queen’s Hall, as a Parents’ Group we agreed to keep our lines of communication open & up to date.

As part of the ongoing political process, a Motion was tabled in the Assembly on Monday 15th March, opposing the proposed removal of Preparatory School funding. Whilst the Education Minister’s viewpoint remained, predictably, unchanged, the motion was debated robustly.

A strong contingent from our Parents’ Group & teachers were in attendance & we are pleased to advise you that the Motion, in its final form (Sinn Fein’s amendment having been rejected), received convincing cross party support. As promised, DUP & UUP had full party representation, however, we were delighted by the level of very vocal support & commitment shown by SDLP & Alliance. Our spontaneous applause at one point gave us the opportunity to express our support for the arguments being made, an action which was much appreciated by the Education Committee, but not so much by the Chair!

As expected, the Education Minister confirmed that no decision would be made until the findings of the EQIA Public Consultation were summarised & made available to her. We are, however, very encouraged by today’s proceedings & we will continue, on your behalf, to concentrate our efforts on political & legal response.

We will, keep you advised of progress made, including budgetary information, as & when this becomes available. - Aim of meeting in general to inform parents of the progression made since the meeting Thurs 25th Feb. Explained that there were a variety of people present who would advise parents of the events which would indicate a more positive outcome than previously expected.

- Purpose – summary of meeting 10 days ago. Information indicated there may be extra fees of £808, the controlled status of RHS Prep was explained and the issues that may arise because of this, the SEELB stance with reference to the proposals. Attention was brought to parents of the need to write to as many relevant parties as possible, MLA’s, Human Rights Commission, etc. as a matter of urgency. MLA Mervyn Storey referred to the aim of getting this matter into the Assembly.

Liz Breadon – General Update

- There have been several developments since meeting. Lobbying MLA’s for support, response to Chris McRoberts Dept. of Education, consider lagal opinion, other schools involvement (combining forces) – all very positive.

Liz continues: “…aim is simply to present you with facts, and not to speculate”

- Contact sheet to be filled in - for those who could not attend, you can request this form from any of the parent representatives , details given on Home page.

- If any parent feels that they can assist in any way, their help would be welcome.

Michelle Edgar – John Ross & Son Solicitors

Information needed to formulate test cases. Proposed 2 avenues to follow:

- Attempt to stop now, with reference to the difficulties presented

- Longer term picture.

Request – could all parents fill in the questionnaire provided at the meeting. It will be treated in confidence.

Mrs. Packham – Acting Head of Dept.

- Giving teachers’ perspective

- What is happening to date? – some people have left or are considering leaving. Coping with uncertainty may be the issue.

- Encouraging figures to report – since Jan +3 pupils, since Jan -3 pupils. 3 more children waiting to enroll in next 2 weeks.

- Teachers are very encouraged – it is ‘business as usual’

- Reference made to the report “Consultation on the Proposed Changes to Common Funds Scheme for the Local Management of Schools.” No specific detail given, however Mrs. Packham able to report that the findings of the Board refer to proposals as “ unworkable, undeliverable, and unreasonable.”

- In addition to DUP support, we have had positive support from Alliance and SDLP.

- A motion has been tabled in the Assembly.

- People may attend if they wish – see Assembly website for details.

- The response to the Education Minister, made by the SEELB is strongly worded – they have concerns.

- Education Minister has not carried out proper consultations – parents have not been consulted.

In response to question by L.Simpson, it was stated that “…there may not be a vote – you will witness the debate and hear her argument.”

- Confident Prep will continue in its’ present form.

- Aware of response submitted by SEELB to Education Minister – key issues – proposals are ‘unachievable, unrealistic, unworkable.’

- Education budgets are to be submitted by 15th March

- Minister of Education will be taken for Judicial Review, as she has failed to follow due process.

In response to question from J. Hunter, it was felt that the Education Minister will not get the cross – community support within the 10 ministers in the Executive.

In response to question from Alan Shields in relation to the 2 Departments (Education and Finance), there was no proposal from the Finance Dept. to withdraw funding. The Bain Report was jointly commissioned, but not jointly taken forward.

- Senior Counsel have advised that there is a strong chance for this to be overturned.

- All information gathered to date indicates a strong and bright future for Prep. Schools.

- Board of Governors are unanimous in their support.

- At Board meeting, resolution passed – unswerving support for parents, pupils, and staff.

- Issue of confidence – vital all hold steady until Ministers’ decision.

Julie Rainey - summary of political responses

- Support from DUP, Alliance, SDLP, UUP

- Finance Minister – issue will be brought to the Executive for cross – community vote.

- Equality Commission – have sent acknowledgement.

- NI Human Rights – have said in their opinion it is not a Human Rights issue.

Anna Lo – MLA Alliance is asking at the motion on Monday for an update on Dept. funding for Prep. Schools, and an estimate of additional costs over next 3 years if proposals go ahead.

Julie confirmed that she had been in contact with Ms Lo, making her aware of RHS current position and had received an email from her saying that she will ask an additional question re controlled schools.

Julie has also contacted Lorde Browne, who is also asking a question on Monday 15th March, to make him also aware of RHS's current predicament.

- DUP comment, from David McNarry that “..you can make a difference by writing”

Julie-Ann Augusto – Ards Borough Council Meeting

- Deputation arranged to address Ards Borough Council, Tues 9th March. Need parents’ support, keep energy going, and please join us tomorrow evening.

In response to question from Claire Thompson, advice given to request from the Dept. of Education, under the Freedom of Information Act the form:

‘ Consultation on Proposed Changes to the Common Funding Scheme for the Local Management of Schools.’

Mrs. Packham – Acting Head of Dept

Alan Shields asks “will there be any way back for such parents who have been ‘scared’ into making a decision?” In response, Mrs. Packham advises that there is an open door policy, but cases would have to be discussed.

L. Romein, parent, informs the Floor that:

- Her son was moved out of mainstream primary into Prep.

- All the extras we take for granted will not be had in other schools.

- She would urge parents to have faith.

- She will not be taking her son out.

- How would parents like to receive updates and information?

Parents agreed the blogsite was the most satisfactory way.

There followed a full and frank discussion on the benefits of pursuing a Judicial Review. More information later.

Meeting closed at 9.30pm – with vote of thanks from the Chair.

Next Parent's Meeting at Queen's Hall- Monday 8th March - 7.15pm

The next RHS Prep parent's meeting will be held at the Queen's Hall (behind the library, West Street, Newtownards BT23 4EN), on Monday 8th March, starting at 7.15pm. The purpose of the meeting is to advise parents of progression over the last 7-10 days, and the way forward.

We hope to see as many parents as possible.

As parents, what can we do?

UPDATE 14/03/10

After speculation and open discussions on various websites, over the type of attendance at the motion at Stormont on Monday 15th March, our parents group agreed at a meeting on Thursday night that the consensus of our group was that only named parents who have accepted the invitation of Michelle McIlveen to attend the motion will be doing so. RHS parent's group have no plans to bring children to the motion or to demonstrate our feelings in any other way.

We understand that all parents have their own choice to take their children to Stormont of their own accord, but it is reminded that this will not have been organised by the RHS parent group and that any other show of support would need to be confirmed with officials are Stormont independently.

UPDATE - 05/03/10

Just because the deadline for a response to the Dept of Education Impact Assessment passed on Thursday 4th March), does not mean that we can't continue to write to everyone else. WE CAN KEEP WRITING TO OTHERS. THERE IS NO OTHER DEADLINE FOR THEM. KEEP THE PRESSURE UP AND WRITE TO MLA'S, COMMISSIONERS, AND OTHER RELEVANT PEOPLE.

FYI, I have been doing as I recommended below ie emailing letters to
MLAs requesting acknowledgements to be sent back by email - in almost
all cases to date the acknowledgement is very prompt - so it works,
saves time & extends your mailing deadline so you can get as many
letters out as poss.

Some additional points that where discussed on Thursday night to add within your letters.....

Assembly budget/financial issues

Executive needs to find £70m savings. Despite this, should proposals go ahead, the additional cost of prep school pupils moving to mainstream will be £3,186k pa, excluding redundancy costs of teachers & other staff in 17 schools

Equality/Human Rights/Discrimination/Legislation issues

C Ruane calls grammar schools ‘breakaway schools’ despite them educating 42% of post-primary school aged children in NI. Compare this to SF’s share of vote in last Assembly elections being 26%
Current DENI funding already promotes 2 sectors (integrated & Irish medium) to the disadvantage of others. Integrated/Irish medium sectors are fully funded compared to Prep schools 30%. All sectors of education system should be valued
All Prep schools are Protestant or non-denominational – discrimination issue re. SF proposals directly affecting only 1 side of the community
Note unfair treatment of Prep Schools to date in gradual decrease in funding from 80% to current 30% with current proposal now for nil

Educational standards

How can proposals be consistent with desire to raise standards?– refer to KS2 results table v. mainstream primary schools
Adding to existing problem of NI having largest class sizes in UK
CR should be ashamed of decline in primary schools – SF support smaller class numbers but not delivered. Key issue – raising standards
Consideration for funding schools based on outcomes/results – Irish medium schools are not value for money in this regard. Performance of schools should be key, not socio-economic factors

Sedley requirements re. consultation

DENI’s decision does not meet these due to its predetermined outcome. This makes it a political decision & M McIlveen has called for reversal. Evidence of this:

DE have already reduced their bid to SEELB
Report completed in late 09, not received by Education Committee until mid Jan 10

As you are aware, we received information last week from Mr. R. McFerran, Chairman, Board of Governors. The information provided recommended that parents ought to lodge their objections to the proposed removal of the partial funding of prep schools with effect from 1st Sept, 2010.


Since this letter was received, there has been widespread concern amongst parents about the future financial implications this would have on families. The meeting on Thursday has been arranged to give parents the opportunity to raise these concerns with Dr. McCavery and the Board of Governors.


By Thursday, 4th March 2010, objections to the proposed removal of partial funding must be lodged. It is vital that parents take the time to lodge their objections to local MLAs, local councillors, the Education Minister, and to MP’s before this date. There is a legal obligation to respond to each and every letter received, and the more objections received , the stronger the case to be put forward to the Executive.


The intention is simply to try to give parents all the information they need in the short timescale which has been given, to formulate a weighty response which will have an impact on stalling Caitriona Ruane’ proposals indefinitely.


This is a difficult time for the Preparatory Department. It is a time when parents need to be well informed on a regular basis about the progress being made by the Board of Governors. As parents we are sure that a common desire would be to minimize any disruption to our children and with this in mind we would urge you to reflect on your initial reasons for choosing Regent House Preparatory Department over mainstream schools for your child / childrens' education. Despite the uncertainty, there is a need for parents to remain calm and to remain loyal to the Prep.


Please do your utmost to attend the meeting on Thursday 25th February. This will be an opportunity to answer all those questions you may have, and hopefully to reassure you that if we remain supportive to the school, the school will remain supportive to parents / children, and we can focus on the common objective of ensuring our children gain an excellent standard of education.
